Introduction:
These Terms of Use (“Terms”) govern your access to and use of topgreencard.com and any related pages, features, tools, and services (collectively, the “Website” and the “Platform”). The Platform is operated by EpTau Innovation LLC (“Top Green Card,” “TGC,” “we,” “us,” “our”).
By accessing or using the Platform (including creating an account, using any free features, or purchasing SmartFile), you agree to these Terms. If you do not agree, do not use the Platform.
1. Definitions
For clarity in these Terms:

“Platform” means TGC’s software-based tools and workflows made available through the Website.

“BluePrint” means TGC’s free plan with limited features.

“SmartFile” means TGC’s paid plan with expanded automation and packet-preparation features (as described on the Website at purchase).

“Outputs” means documents, drafts, PDFs, check results, packet order files, and other materials generated by the Platform based on your inputs.
-
“User Content” means information and materials you provide or upload (including documents, images, and data).
-
“USCIS” means U.S. Citizenship and Immigration Services.
2. Nature of the Platform (Software; Self-Help)
TGC is a self-help software Platform designed to help users prepare a marriage-based (spouse) green card application package in a structured way. The Platform uses structured automation workflows to organize user-provided information across forms and assist in assembling a complete filing packet, not just USCIS standard forms.
TGC is not a law firm and does not provide legal advice, legal representation, or legal services. Using TGC does not create an attorney–client relationship.
3. Scope and Intended Use (Marriage-Based Only)
The Platform is intended for marriage-based (spouse) green card preparation. It is not designed for every immigration category or every situation.
If your situation is complex (for example: criminal history, prior denials, removal proceedings, fraud/misrepresentation issues, waivers, or other high-complexity circumstances), you should consult a licensed immigration attorney or accredited representative.
4. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Platform. You represent that you meet these requirements. To use any of our services you must meet the eligibility criteria available at our website.
5. Plans: BluePrint (Free) vs SmartFile (Paid)
5.1 BluePrint (Free)
BluePrint is a free plan that provides limited features and does not include the full SmartFile automation.
5.2 SmartFile (Paid)
SmartFile is a paid plan and includes the specific features described on the Website at the time of purchase.
6. Account Registration and Security
You may need an account to use portions of the Platform. You agree to:

provide accurate information,
-
keep credentials confidential,
-
promptly notify us of unauthorized access.
You are responsible for all activity under your account.
7. License and Access (Personal Use; Non-Transferable)
Subject to these Terms, TGC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial use.
You may not:
-
share, resell, sublicense, or transfer access,
-
allow third parties to use your account,
-
use the Platform for commercial solicitation or competitive analysis.
8. Access Period
Unless stated otherwise on the Website, SmartFile provides access for six (6) months from purchase (the “Access Period”). BluePrint access is available while the plan is offered.
You are responsible for downloading and saving your Outputs during the Access Period. We may, but are not obligated to, provide access after the Access Period. Users are encouraged to download and securely store their Outputs during the Access Period.
9. Your Responsibilities
You are solely responsible for:
-
the accuracy of all information you enter,
-
reviewing all Outputs before use,
-
printing, signing, assembling, and mailing your packet,
-
selecting shipping method, and carrier,
-
paying all required government filing fees and third-party fees,
-
following the most current government instructions.
TGC does not submit anything to USCIS for you.
You acknowledge and agree that you are not relying on TGC for legal advice, eligibility determinations, or compliance decisions. You are solely responsible for evaluating your own immigration approach and deciding whether to consult an attorney or accredited representative.
10. Payments, Pricing, and Taxes (SmartFile)
Prices are shown on the Website at checkout and may change. SmartFile is generally a one-time purchase unless stated otherwise.
Government filing fees (USCIS fees), medical exam costs, translation fees, shipping fees, and any third-party costs are not included unless explicitly stated.
If taxes apply, they may be added at checkout as required.
11. Refund Policy (SmartFile Only; BluePrint Not Refundable)
BluePrint is free and not refundable. This section applies to SmartFile only.
11.1 30-Day “No-Questions-Asked” Refund (Limited Use)
You may request a refund within 30 days of purchase if you have not:
downloaded/exported any SmartFile-generated USCIS forms, and/or
downloaded/exported any SmartFile-generated packet Outputs (if provided), and/or
used SmartFile in a way that produces final filing Outputs.
Refunds will be limited to the amount actually paid (including discounts applied; no refund above the paid amount).

11.2 Platform Accountability Support (SmartFile Only)
For purposes of this Section, “denial” means a formal adjudicative decision by USCIS after review of the filing, and does not include rejections, returned filings, Requests for Evidence (RFEs), or other preliminary procedural actions.
For purposes of this Section, “rejection” refers to a filing returned or not accepted by USCIS prior to adjudication.
If a documented, platform-generated error in SmartFile Output directly results in a formal USCIS denial of the user’s marriage-based filing, TGC may provide reimbursement for reasonable and documented appeal-related legal fees, subject to the following conditions:
1) The denial must have been directly and primarily caused by a defect in the SmartFile-generated Output and not materially contributed to by user-provided information, omissions, modifications, missing signatures, missing evidence, failure to review documents before filing, government policy changes, or circumstances outside the Platform’s control.
2) The user must provide:
- A copy of the official USCIS denial notice;
- Documentation demonstrating the alleged platform-generated defect;
- A detailed explanation from a licensed attorney confirming that the denial was directly caused by the identified platform-generated defect and not materially contributed to by user-provided information or omissions;
- An itemized legal invoice for appeal-related services.
3) Reimbursement is limited to $1,400.00 USD per case.
4) TGC reserves the right to independently review and verify the claimed defect before issuing any reimbursement.
5) This provision does not constitute legal representation, an admission of liability, or a guarantee of appeal success.
This support applies exclusively to SmartFile users and is not available under the BluePrint plan.
12. SmartFile Output Defect Refund (Rejection Due to Platform-Generated Error)
If USCIS rejects (returns unaccepted) your filing package specifically due to a verifiable defect in SmartFile-generated Output (for example: missing generated pages, corrupted output, Platform-caused assembly errors), you may request a refund of the SmartFile amount actually paid.
This does not apply to:
-
RFEs, denials, or approvals (case outcomes),
-
missing signatures,
-
missing evidence you were responsible to provide/upload,
-
incorrect/incomplete information you entered,
-
changes you made after export,
-
outdated instructions/forms after you generated Outputs,
-
issues not caused by a Platform-generated Output defect.
You must provide the USCIS rejection notice and sufficient information for verification. Determination of whether a Platform-generated Output defect exists will be made in TGC’s reasonable discretion based on the documentation you provide. If we cannot verify the cause, we may deny the refund.
Denials caused by a documented platform-generated error may be eligible under Section 11.2 (Platform Accountability Support).
13. No Legal Advice; No Representation; No Guarantees
TGC does not:
-
provide legal advice,
-
apply law to your specific situation,
-
provide legal strategy,
-
represent you before USCIS.
No fiduciary, advisory, or other professional relationship is created by your use of the Platform or by any communications with TGC.
Any examples or sample language (if provided) are general informational self-help content and are not legal advice.
USCIS (and other government agencies) alone determines acceptance, adjudication, processing time, and outcomes. TGC does not guarantee any outcome.
14. Non-Affiliation; No Intermediary; No Filing
TGC is not affiliated with, endorsed by, or connected to USCIS or any government agency.
TGC is not an intermediary between you and USCIS. We do not:

file applications,
-
communicate with USCIS on your behalf,
-
act as your agent or representative.
15. User Content (Uploads and Responsibility)
You may upload User Content to use Platform features. You represent you have the rights to provide and upload your User Content.
You are responsible for:
-
your User Content,
-
the legality and accuracy of what you upload,
-
ensuring you do not upload content you do not have rights to use.
16. Prohibited Activities
You agree not to:
-
use the Platform for unlawful purposes,
-
upload malware or attempt unauthorized access,
-
scrape, crawl, or overload the Website,
-
impersonate others or misrepresent affiliation,
-
harass, abuse, threaten, or defraud,
-
bypass security measures,
-
violate intellectual property rights.
We may suspend or terminate accounts for violations.
17. Intellectual Property; Outputs; Images and Icons
The Platform (software, workflows, design, text, and materials) is owned by TGC and protected by intellectual property laws.
17.1 Platform IP
You may not copy, distribute, reverse engineer, or create derivative works from the Platform.
17.2 Your Outputs (Personal Use)
You may download and use your Outputs for personal use (including printing and filing). You may not resell, publish, or redistribute Platform materials or workflows.
17.3 Images and Icons
Some images, icons, or third-party marks displayed on the Website may be owned by third parties. Nothing in these Terms grants you rights to third-party marks. If any third-party owner requests removal, we may remove or replace such content.
18. External Content and Third-Party Links
We may link to third-party websites (including government resources). We do not control and are not responsible for third-party content, availability, or policies.
USCIS forms and instructions are available from official government sources. Users should review official instructions and ensure they follow the most current requirements.
19. Privacy and Data Collection
Our collection and processing of personal information is described in our Privacy Policy, available on the Website. By using the Platform, you consent to those practices.
20. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or that any Outputs will be accepted by USCIS.
We do not guarantee that any Platform content, instructions, forms, or Outputs are current, complete, error-free, legally sufficient, or compliant with the most recent government updates. USCIS forms, fees, and filing requirements may change at any time. You are responsible for confirming you are using the correct and most current government forms and instructions before filing.
21. Limitation of Liability
To the fullest extent permitted by law:

TGC is not liable for indirect, incidental, special, consequential, or punitive damages.

TGC is not liable for any unauthorized access to your account, loss of data, loss of User Content or Outputs, service interruptions, or security incidents, except to the extent such liability cannot be limited under applicable law. Without limiting the foregoing, TGC is not liable for any loss of immigration benefits, missed filing windows or deadlines, loss of opportunity, status-related consequences, or government penalties arising from your use of the Platform.

TGC is not liable for USCIS outcomes, processing times, delays, RFEs, denials, approvals, or rejections except as expressly stated in Section 12 (SmartFile Quality Refund).
For BluePrint (free) users, TGC’s total liability for any claim is limited to $0 to the maximum extent permitted by law.
Except as expressly provided in the Platform Accountability Support section, TGC’s total aggregate liability shall not exceed the amount paid for SmartFile in the twelve (12) months preceding the event giving rise to the claim.
22. Indemnification
You agree to indemnify, defend, and hold harmless TGC, EpTau Innovation LLC, and our affiliates, officers, directors, employees, agents, contractors, and licensors from claims arising out of:

your use of the Platform,
-
your User Content,
-
your violation of these Terms,
-
your violation of law or third-party rights.
23. Dispute Resolution; Arbitration; Class Action Waiver; Jury Waiver
This section affects your legal rights.
23.1 Informal Resolution First
Before starting arbitration, you agree to contact us at support@topgreencard.com
and attempt to resolve the dispute informally.
23.2 Binding Arbitration
If not resolved, any dispute arising out of or relating to these Terms or the Platform will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (or, if applicable, its Commercial Arbitration Rules), as modified by these Terms.
23.3 Class Action Waiver
You agree to bring claims only on an individual basis. No class actions, collective actions, or representative actions are permitted.
23.4 Waiver of Jury Trial
You waive the right to a jury trial.
23.5 Arbitration Location and Format
Arbitration will take place in Massachusetts, unless you and TGC agree otherwise. The arbitrator may conduct proceedings by video, phone, or written submissions where permitted by the applicable rules.
23.6 Fees and Costs
Payment of arbitration fees will be governed by the AAA rules and applicable law. Each party will bear its own attorneys’ fees and costs unless the arbitrator awards fees under applicable law.
23.7 How to Start Arbitration
To start arbitration, you must send a written Notice of Dispute to support@topgreencard.com
describing the dispute and the relief you seek. If the dispute is not resolved after good-faith efforts, either party may initiate arbitration through the AAA.
23.8 Small Claims Court Option
Either party may bring an eligible claim in small claims court instead of arbitration, provided the claim remains in small claims court and proceeds only on an individual basis.
23.9 Survival
This arbitration agreement survives the termination of your relationship with TGC.
24. Termination; Suspension; Changes to the Platform
We may suspend or terminate your access to the Platform at any time if:

you violate these Terms,
-
we suspect fraud or misuse,
-
required by law,
-
or to protect the Platform, users, or TGC.
We may modify, discontinue, or update features, including BluePrint and SmartFile features, at any time. Feature descriptions are those shown on the Website at time of use/purchase.
25. Contract Mechanics: Governing Law; Entire Agreement; Severability; Waiver; Headings; Assignment; Force Majeure; Contact
25.1 Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, except where arbitration rules require otherwise.
25.2 Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and TGC regarding the Platform and supersede prior or contemporaneous agreements or understandings.
25.3 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
25.4 Waiver
Failure to enforce any provision is not a waiver of that provision or any other provision.
25.5 Headings
Headings are for convenience only and do not affect interpretation.
25.6 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
25.7 Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (including outages, internet failures, natural disasters, or government actions).

25.9 Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Website with a revised “Last update” date. Unless otherwise stated, the updated Terms are effective when posted. Your continued use of the Platform after updated Terms are posted constitutes your acceptance of the changes.
25.10 Electronic Communications; Notices
You consent to receive communications electronically from TGC, including notices, agreements, disclosures, and updates. You agree that emails and other electronic communications satisfy any legal requirement that such communications be in writing. Notices to TGC must be sent to support@topgreencard.com
