Introduction:
These Terms and Conditions ("Agreement") govern the use of the entire website and the online program payment form ("Form") provided by Top Green Card (TGC), owned by EpTau Innovation LLC, ("Seller") on the website located at topgreencard.com ("Website") for the purchase of access to the Top Green Card Proprietary Process -TPP- online program ("Program"). By using the Form, you agree to comply with and be bound by these terms. Please read this Agreement carefully.

 

1. Acceptance of Terms
By accessing our website and/or submitting payment for an online program through this form, you agree to be bound by the following terms and conditions.

 

2. Access
Site Access:
Pursuant to the provisions outlined in this Agreement, you are granted a non-exclusive, limited, non-transferable, and revocable license to access and utilize the Site. This access is solely intended for your personal, noncommercial use and is subject to compliance with the terms and conditions set forth herein, as well as any restrictions imposed by the Site's features.
Please be aware that the Seller retains all rights that have not been expressly granted within this Agreement, both with regard to the Site and the content provided by TGC. It is important to note that TGC reserves the right to terminate this license at any time, and such termination may occur with or without reason.
Users agree that the use of the website is entirely at their own risk.
The website is provided "as is" without any warranties, including those related to information, data, services, and product availability.

Program Access:
Upon successful payment, the Seller will provide you with access to the Program through login credentials or other appropriate means. Access will be granted within a reasonable time frame.
License: Your purchase of the Class entitles you to personal, non-transferable, and non-exclusive access to the Program for your own educational purposes. You may not share, distribute, or resell access to the Program.
Access Duration: Upon successful payment, you will be granted access to the Program for a duration of 12 months. The access period will commence immediately after completing the payment.

User Conduct:
Users must not restrict other users from enjoying the site.
Prohibited actions include posting unlawful, defamatory, or offensive content.
Users must not engage in spamming, post harmful software, or use the site for commercial purposes.
Uploading or distributing copyrighted material without permission is not allowed.
Users cannot distribute or create derivative works based on the website itself, which is copyrighted.

User-Generated Content:
Users are solely responsible for the content they provide on the website, which may include data, text, images, and more.
Certain functionality on the site may depend on user-provided content, and this content may not be available without it.

Seller is not responsible for any user-generated content and shall not be held liable for any claims or damages arising from such content.

User Forum:
The user forum is a place for users to share ideas and experiences related to the use of the website and services. However, it is important to note that the user forum is not a place to seek legal or professional advice.
Providing legal or any type of professional advice in the user's forum is strictly prohibited. Users must not interpret any of the information provided by other users as legal or professional advice.
If you need legal or professional advice, you should consult with a qualified professional.
 

3. Payment and Pricing
Payment:
The Seller accepts payments for access to the Program through the Form. Payment may be made using the methods provided on the Form, which may include credit/debit cards, or other authorized payment methods.
All payments must be made in full before you are granted access to the Program.

Pricing:
The pricing for the Program is as stated on the Form and is subject to change at the Seller's discretion. The prices may be exclusive of taxes and additional fees. By using the Form, you agree to pay the specified amount.
The price displayed on the Website is the total price before local and federal taxes. At checkout, we will split the total amount into two concepts without modifying the total displayed amount. You will be charged the full amount as initially shown during the checkout process.

Note: The price displayed on the Website is the total price for the Program and includes only the items and services explicitly mentioned on our webpage. This price does not cover additional expenses such as USCIS filing fees, carrier fees, or any other costs not explicitly stated in our advertising materials. Any such additional fees or expenses are the sole responsibility of the user and should be budgeted for accordingly.

 

4. Refunds and Cancellations
We have a strict no-refund policy for our Program, except under the following circumstances:

1. A refund will be provided if the user has neither opened nor initiated the program and has not downloaded any materials from the program.

2. The user must contact us within 30 days of purchasing access to the program to be eligible for a refund under the conditions mentioned in (1).

For any refund requests meeting the above criteria, please contact us at support@topgreencard.com within the specified time frame to initiate the refund process.

 

5. Money-back program
The Seller offers a Money-Back/Refund program to our users under the following conditions:
Refund number 1:
Users are eligible for the first refund of up to $199 if they share details of their case by completing the form available on their members portal. This form must be submitted within the first 2 months of accessing our portal, and the information must be verified by our team before issuing a refund. Note: If our team is unable to verify the information provided by the user, no refunds will be issued.
Refund number 2:
Users may qualify for a second refund of up to $649 under the following circumstances:

• The user didn’t receive refund number 1. In the case the user has previously received refund number one the user will be still eligible to receive a refund of $450 for the selected program, provided that they did not use any coupons, promotional codes, or other discounts when purchasing access and all other eligibility criteria are met.

• The user's case (Form I-485) has not received approval from the USCIS after 12 months from the date indicated on the notification issued by the USCIS, confirming the USCIS's receipt of the user's case.

• The user shares details of their case by completing the form available on their members portal. This form must be submitted within the first 30 days after the 12 months from the date indicated on the notification issued by the USCIS, confirming the USCIS's receipt of the user's case. Our team will verify the case information, if it has not been previously validated, before processing a refund. Note: If our team is unable to verify the information provided by the user, no refunds will be issued.

Exceptions

The "Refund number 2" policy does not apply to purchases made with gift cards or other store credits. Additionally, this policy does not apply to purchases made in conjunction with other promotions or discounts.

Please note that these two refunds represent the maximum available under our Money-Back program, and they are subject to the conditions specified above. Refunds will be processed in accordance with our refund policy, and users are required to adhere to the relevant terms and timelines for each refund type.

 

6. Intellectual Property
The Program and all accompanying materials, including but not limited to videos, documents, and presentations, are protected by copyright. You may not reproduce, distribute, or modify these materials without the express written consent of the Seller.

• The Seller owns all TGC trademarks, service marks, and copyrights.

• Users are not allowed to download, save, or use any content without authorization.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Massachusetts.

 

8. Entire Agreement
These terms and conditions constitute the entire agreement between you and us with respect to your payment for and participation in the Program.
By using the Form and completing the payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with these terms, please do not use the Form.

9. Privacy and Data Collection:
The Seller will collect and process personal information as outlined in the Privacy Policy, which is available on the Website.

10. Dispute Resolution
Any disputes arising from or relating to this Agreement shall be resolved through negotiation in good faith. If a resolution cannot be reached, both parties agree to submit the dispute to binding arbitration.

 

11. Limitation of Liability
The Seller shall not be held liable for any direct, indirect, or consequential damages, including but not limited to loss of profits, arising out of the use of the Form or the Program.
Approval or any other decision related to your case are not guaranteed. While the Program is designed to provide general knowledge, individual results may vary. The Seller does not make any promises or guarantees regarding specific outcomes. Users should understand that their case outcomes depend on their own situation and circumstances. As such, you must not hold the Seller liable for any outcomes, successes, or results (or lack thereof) that may arise directly or indirectly from your participation in the Program. Our program provides information, but we do not accept responsibility for your personal choices, actions, or the consequences that follow. Users are encouraged to exercise their own judgment and make informed decisions.
The user agrees that TGC cannot be held accountable for any delay in the processing times taken by the USCIS.
The Seller’s documents are provided as an example only and it is the user's sole responsibility to complete their immigration forms accurately and truthfully using their own personal information. Failure to do so may have adverse consequences, including denial of the user's immigration application and/or legal liability.
The Seller does not provide assistance on either completing or filing USCIS forms, therefore it is not responsible for any mistake or missing information made by the user.
The content on this site and in our products should not be relied on to reach conclusions about any person’s specific situation.
None of the Seller´s content, including the Program, can be used as proof of USCIS case acceptance in any case, included but not limited in a lawsuit.
The user acknowledges that each USCIS case is unique and time, approval, review might and most likely will be different for everyone. Top Green Card is not responsible for any of the USCIS procedures, including but not limited to acceptance, review, approval and/or denial. Users are responsible for reviewing their forms and the content before filing with the USCIS. TGC cannot be considered either accountable or responsible for any of the content of such forms.
Seller’s programs are adapted from real cases for online distribution and as such cannot be considered as an example of a single specific case.

 

12. Amendments
The Seller reserves the right to modify or amend this Agreement at any time. Any changes will be effective upon posting on the Website, and your continued use of the Form implies acceptance of the revised terms.

 

13. Termination
Termination: The Seller may terminate your access to the Program and Form for any violation of these Terms and Conditions without notice.

 

14. Severability
If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck from these terms and conditions and the remaining provisions shall remain in full force and effect.

 

15. Waiver
No waiver of any provision of these terms and conditions shall be effective unless in writing and signed by both parties.

 

16. Not Legal advice
User recognizes that the Seller is not a law firm and that the content of the Program is not legal advice. If Users have any legal questions or concerns, they should consult with an attorney. The information in the online Program is provided for general knowledge purposes only and is not intended to be a substitute for legal advice. The laws of each jurisdiction vary, and the information in this online class may not be applicable to your specific situation.

 

17. Non-Affiliation
The seller is not affiliated with, endorsed by, or in any way connected to USCIS or any of its associated entities. Our Program is entirely independent, and any references to third-party entities, including USCIS, are solely for informational purposes.

 

18. External Content Disclaimer
The Seller is not responsible for the accuracy, content, or availability of information contained on external websites linked from our website. These external links are provided for reference and convenience, and their content and accessibility are beyond our control.
It is the responsibility of our customers to check the USCIS website to get the most up-to-date information on USCIS forms and how to file such forms.
Users should exercise caution and discretion when navigating to external websites and are encouraged to review the terms and conditions and privacy policies of those external sites.
The Seller do not own any of the USCIS forms, and it is not responsible for their content or any other liability.
All USCIS forms are FREE and can be retrieved directly at the USCIS website.
Instructions on how to file USCIS forms are also available on the USCIS website for free.

 

19. Customer Service
Customer service will only answer questions related to our services and will not answer any question regarding USCIS forms.

 

20. No Intermediary Role
The Seller is an intermediary between users and government agencies or third parties.

 

21. Headings
The headings in these terms and conditions are for convenience only and shall not affect their interpretation.

 

22. Prohibited Activities
By using our website, you agree to refrain from engaging in the following activities:

Unauthorized Copying and Distribution:
You may not copy, distribute, or disclose any part of the website, including using automated or non-automated methods, without our express written permission.
Unreasonable Access and Malicious Software:
You may not use automated systems, such as robots or spiders, to access the website in a way that generates excessive traffic or to upload any harmful software agents.
Spam, Unsolicited Email, and Privacy Violation:
You may not transmit spam, chain letters, or unsolicited emails to other users of the website or collect or harvest any personally identifiable information from other users of the website without their consent.
Commercial Solicitation, Impersonation, and Misrepresentation:
You may not use the website for commercial solicitation purposes without our express written permission, impersonate another person or misrepresent your affiliation with any person or entity, or conduct fraud.
Interference with Proper Functionality and Unauthorized Access:
You may not interfere with the proper functioning of the website or access site content through unauthorized means.
Bypassing Security Measures:
You may not bypass any measures we use to prevent or restrict access to the site, including features that enforce limitations on content use.
 

If we find that you have violated any of these terms, we may take action, including suspending or terminating your account, and we may report you to law enforcement if necessary.
Please adhere to these guidelines to maintain a respectful and secure online environment for all users. Violations of this policy may result in account suspension or other appropriate actions at our discretion.

23. Indemnification Policy
Use of the TGC Website and Services, Breach of Agreement Terms, Infringement of Third-Party Rights, Violation of Applicable Laws, and Willful Misconduct:
You agree to indemnify, defend, and hold harmless TGC and its affiliates, as well as their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or in connection with your use of the TGC website and services, your violation of any of the terms and conditions of this Agreement, including the representations and warranties, your violation of any third-party rights, such as privacy or intellectual property rights, your violation of any applicable laws, rules, or regulations, or your willful misconduct.
Third-Party Usage and User-Generated Content:
You agree to indemnify, defend, and hold harmless TGC and its affiliates, as well as their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or in connection with another party's use of the TGC website and services using your credentials, as well as claims stemming from content generated by you.

 

24. Images and Icons
The Seller does not own some of the images or icons used on the presentations and is not selling those. The Seller also does not own any agency logo or trademark and as such can remove the content per the owner’s request. At Top Green Card we do not commercialize images or logos, and never intend to do it.
